GOOD NEWS: Pharmally execs tagged in more than 8 billion pesos pandemic fund malfeasance released from Pasay City Jail.



 Ferdinand Topacio, legal counsel of Pharmally executives Mohit Dargani and Linconn Ong, told CNN Philippines' The Source just moments before the release that all paperwork is done. His clients are eager to reunite with their families and go on with their lives, he added.

"Si Mr. Linconn Ong po ay sabik nang makita ang asawa, medyo gigil na gigil na nga po ito," he said. "Meron po silang bagong silang na anak that he’s also very eager to see and to hold in his arms."

[Translation: Mr. Linconn Ong is so excited to see his wife, he is trembling with excitement. They have a newborn child that he's also very eager to see and to hold in his arms.]

"He (Dargani) is in good spirits. Mr. Dargani is considered the head of his family. His mom, as we all know, raised him as a single parent. He is also eager to be reunited with his sister whom he is very fond," he added.

Donn Kapunan, who also serves as the Pharmally officials' counsel, told the media in a separate interview that the legal team will have to confer with the two regarding their next move, following their release.

"Ang pangit po ng nangyari. Masyadong nayurakan at nababoy ‘yung karapatan ng mga kliyente ko doon sa Senate investigation na ‘yun,” he said.

[Translation: What happened negatively affected the image and the rights of my clients in that Senate investigation.]

"My clients feel vindicated, as I said, because [Blue Ribbon Committee chairman] Sen. [Richard] Gordon lost and we felt from the very start that he was using this for political purposes, in aid for reelection, not of legislation," he added.

Senate President Vicente Sotto III on Wednesday signed the release orders for Pharmally executives Mohit Dargani and Linconn Ong, the same day the upper chamber adjourned for its last session day in the 18th Congress.

Dargani and Ong were detained for failing to submit documents requested by the Senate Blue Ribbon Committee for its inquiry on the allegedly anomalous multibillion-peso deal between the government and Pharmally for the purchase of medical supplies for COVID-19 response.

In a previous interview, Gordon said he did not approve the release. He believes Dargani and Ong should stay in jail until the 18th Congress officially closes on June 30.

Dargani and Ong were detained for failing to submit documents requested by the Senate Blue Ribbon Committee for its inquiry on the allegedly anomalous multibillion-peso deal between the government and Pharmally for the purchase of medical supplies for COVID-19 response.

The panel’s draft report on the Pharmally controversy has failed to hurdle the committee level as it lacks at least two more signatures that will complete the nine required before it reaches the Senate plenary floor.

Senate Majority Leader Juan Miguel Zubiri and Senator Sherwin Gatchalian said they did not sign the report because they did not agree with the recommendation to charge President Rodrigo Duterte.

“I’ll be very honest about it. Kung wala doon ‘yung pangalan ni President Duterte for plunder I'll sign it…Circumstantial evidence eh, by association kaya sinama. Kung tanggalin lang ‘yun, I’ll sign. If it’s just the Pharmally executives wala akong problema,” Zubiri explained.

[Translation: If President Duterte’s name is not there for plunder I'll sign it… Circumstantial evidence, by association, that's why it was included. If it was removed, I'll sign. If it’s just the Pharmally executives I have no problem.]

Gordon said he is leaving it to the next Congress. The report is now a public record and even private citizens can use it to file a complaint against those involved.

Senator Risa Hontiveros said she is “very willing” to file a resolution to reopen the investigation in the 19th Congress.

Topacio slammed this possible move, claiming that Hontiveros would only be "grandstanding" as the lone opposition senator in the chamber. He said there should be clear-cut rules surrounding the right to arrest and detain, limiting the powers of the Senate.

He also threatened to sue Hontiveros for supposedly trying to secure a false testimony against his clients, a claim which the senator once again refuted.

"May resibo kaming nagpapatunay na wala kaming kinoerce na saksi. Wala kaming pinilit na kahit sinuman," she said.

[Translation: We have proof that we did not coerce any witness. We did not force anyone.]
